Grounds for Divorce:The court may grant a no-fault divorce upon a showing of (1) incompatibility, (2) the irretrievable breakdown of the marriage, and/or (3) voluntary abandonment. The court may grant a fault divorce for any of the following causes:
1. Physical and incurable incapacitation at the time of entering into the marriage
2. Adultery
3. Imprisonment
4. Habitual drunkenness or to habitual use of opium, morphine, cocaine or other “like” drugs
5. Incurable insanity
6. Pregnancy at the time of marriage by a man other than the husband
7. Domestic violence or abuse
8. Living separate and apart from the bed and board of the husband for two years.

Residency Requirements: “Complaints for divorce may be filed in the circuit court of the county in which the defendant resides, or in the circuit court of the county in which the parties resided when the separation occurred, or if the defendant is a nonresident, then in the circuit court of the county in which the other party to the marriage resides.” [Code of Alabama]
