Do you have any recommndations for preparing to go to trial as my husband won’t sign our settlement agreement? I dont have representation anymore as I couldnt afford it but I want to be prepared as I can. I am in Oregon. Thanks..
Preparing for trial can be very challenging to do on one’s own. If you cannot or do not want to work with a lawyer, there are a few other options:
1. Go to the Self-Help Center at your family court and ask for assistance. They will not give you any legal advice, but they can help you find the forms and resources you need to proceed.
2. Go to your local law library and ask the librarian to show you all of the trial practice guides or manuals that lawyers use. An example of some of the guide’s we have in California are The Rutter Group called California Practice Guide, Family Law, written by Judge William P. Hogoboom (Ret.) and Justice Donald B. King (Ret.) – CFLR Court Companion, Matthew and Bender’s California Family Law Litigation Guide…and others.
Oregon should have similar resources. You can do a Google search for Oregon family law trial preparation or practice guides.
Also, have you asked your spouse if he will mediate to try and settle without going to trial? If not, it’s always worth a shot.
