If one spouse wants a divorce in California and all of the residency requirements are met, the court will grant a divorce. If neither party want a divorce, but a Petition has already been filed, you&#039;ll need to take steps to withdraw the Petition or, if the divorce process is further along, both parties have to Stipulate to withdrawing the divorce, in writing and it must be approved by the Court.
