Doggie-Dog Divorce

For those of you whose pets are part of the family and you worry about their well being after divorce, there’s good news in California.

“On September 11, 2007 California Governor Arnold Schwarzenegger signed into law SB 353 amending Family Code §6320 to provide that a Court, upon a showing a good cause, may grant exclusive care of any animal to a party, and may further restrain the other party from taking, attacking or harming the animal. The legislation was introduced by Senator Kuehl. The entirety of the bill, including modified Family Code Section 6320, can be read by clicking here.”

Of course the possible down side to this bill is cats and dogs, like children, could become the subjects of custody battles that prolong a parties’ divorce and increase the costs. That said, if you’re divorcing and want to keep your pets, be sure to include dog, cat, rabbit… custody clauses in your divorce judgment and/or marital settlement agreement. Power to the pooch!
