The “separation date” is defined in some states, by the occurrence of a physical event, such as filing a legal Complaint, while in others, it is determined by less concrete actions.

In all states, however, the “separation date” is a significant event in the legal process. It affects the characterization of property (i.e. separate or community), the duration of spousal support payments, the valuation and division of assets and a variety of other issues.

Thus, before you specify a separation date in any legal documents, research your state’s laws to establish it with reasonable accuracy.
