Before you file for divorce or as soon as you are served, contact your family court clerk and ask which judge or commissioner is, or will be, assigned to your case. Then, investigate the judge or commisisoner’s history on the bench.

Ask your friends, family, court employees, lawyers and mediators whether they know if the judge or commissioner appears to favor men or women, has notable biases associated with specific issues (i.e. rarely orders spousal support payments in marriages of short duration) or has a positive or negative reputation in the community.
If you determine your judge or commissioner’s history could hurt your case, ask your lawyer or court clerk if your case can be assigned or reassigned to an alternate judge or commissioner. If it can, research the alternate and ask your lawyer if your case should be filed or transferred.
